摘 要
社會(huì)存在決定社會(huì)意識(shí),思想理論的產(chǎn)生并非偶然,有其深厚的歷史根源,它是由其所處社會(huì)的政治經(jīng)濟(jì)客觀因素和思想意識(shí)主觀因素所決定的產(chǎn)物。韓非的法治思想產(chǎn)生于戰(zhàn)國(guó)末期,他認(rèn)為德治、禮治等不能解決亂世中的社會(huì)矛盾,在“禮崩樂(lè)壞”的亂世中提倡德治、禮治是不合時(shí)宜的,只有法治才是治亂世之道。于是,他全面總結(jié)了春秋戰(zhàn)國(guó)以來(lái)各國(guó)的變法歷史經(jīng)驗(yàn),批判地繼承和發(fā)展了商鞅、申不害、慎到的思想,形成了系統(tǒng)的“法”、“術(shù)”、“勢(shì)”相結(jié)合的法治理論。該法治思想作為特定歷史的產(chǎn)物,在中國(guó)古代思想史上占有重要的地位,對(duì)中國(guó)的傳統(tǒng)文化產(chǎn)生了重要的影響,這些影響有積極的一面,也有消極的一面。韓非的法治思想雖然目的是為了加強(qiáng)君主專制,與現(xiàn)代的法治思想有本質(zhì)的區(qū)別,但它作為寶貴的文化遺產(chǎn),對(duì)現(xiàn)代中國(guó)的法治建設(shè)仍有一定的現(xiàn)實(shí)價(jià)值。所以,我們要正確看待韓非的法治思想,吸收其精華,棄其糟粕,做到古為今用。

Abstract
Man's social being decides his social consciousness. The emergence of thought or theory was not accidental but deep in historical root, it is the product that determined by the objective factors of political economy and subjective factors of ideology in the social. Han Fei’s legalist thought rose at the end of the Warring States, he considered that the rule of virtue and the rule of Li can not solve the social contradictions at the troubled times. the rule of virtue and the rule of Li were not suited to turbulent days in which the virtue and Li had been destroyed,and the rule of law is the only way to govern the social. So he summarized the historical experiences of institutional reforms of every kingdom since the Spring and Autumn Periods and the Warring States, inherited and developed Shang Yang's, Shen Bu hai's and Shen Dao's legalist thoughts critically, and formed the combined legalist thought of "law", "strategy" and" power" systematically. The rule of law as the specific historical product , were important in the ancient ideological history of China, has greatly influenced Chinese traditional culture, and it has positive aspect and negative aspect. Although Han Fei’s legalist thought aims to strengthen despotism, are essential different from the modern legalist thought, as a valuable cultural heritage, it still has real value to the rule of law in modern China. So we must appraise Han Fei’s legalist thought accurately, absorb the quintessence and abandon the waste matter in order to make the past serve the present.
