摘    要
      財產權不僅是人權的重要組成部分，也是人權其他部分得以實現的重要保障。加強人權保障，這是刑事訴訟法的發展方向，而且，刑事訴訟法既有保障財產權的一面，也有對財產權構成威脅的一面，加強刑事訴訟法的財產權保障功能，應當是刑事訴訟法的發展方向之一。我國刑事訴訟法向來側重于犯罪行為人刑事責任的追究，而對于財產權的保障缺乏關注，導致我國刑事訴訟的偵查程序與有關涉案財產處理程序上存在諸多問題。現在，隨著刑事訴訟人權保障功能的重視，犯罪嫌疑人、被告人的人身權利保障日益受到重視，但相關人員的合法財產權的保障仍然成為問題。在國外，由于向來注重公民個人財產權的保障，不管是大陸法系國家還是英美法系國家的刑事訴訟，都比較重視對財產權的保障，對財產權的保障要求被視為刑事訴訟正當程序的基本要求之一，在審前偵查程序、公訴程序以及審判程序都比較注重對相關財產權的保障。目前，財產權在我國越來越受到重視，刑事訴訟程序的設計也應當體現這一點。為此，我們應當根據我國的國情，借鑒國外的有益立法經驗與實踐，通過限制司法機關的部分權力，賦予涉案財產合法持有人應有的權利、強化涉案財物處分程序的正當化來完善刑事訴訟程序對財產權的保障。

Abstract
Property right is not only an important part of human rights, but also is a very important guarantee to realize the other parts of human rights. Strengthening human rights protection is the development direction of the criminal procedure law. Moreover, the criminal procedure law not only protects property rights, but poses a threat to them. It should be one of the development directions of the criminal procedure law to strengthen the function of the guarantee on property right. The criminal responsibility investigation of the criminals is emphasized in criminal procedure law of our country, but the guarantee on property right is usually neglected, which result in some problems that investigation procedure and the processing program of the property involved in the case in criminal procedure law of our country. Nowadays, with the attention to the function of human rights protection in criminal procedure, the suspects and the personal rights of defendants are increasingly concerned, but there are still some problems in the protection of legal property rights of related people. In overseas, the protection of property right of individual citizens has always been emphasized, so they all pay attention to it whatever the criminal procedure of the civil law countries or the common law system countries. The requirement of the protection of property right is considered as one of the basic requirement of due process of criminal procedure. And just because of it, pretrial investigation procedure，the procedure of public litigation and the trial procedure all pay attention to the protection of the property right comparatively. In recent years, the property right has been emphasized more and more, so the design of criminal procedure should also present it. Therefore, according to the situation of our country, we should endow deserved right with the property of lawful holder involved in case by using the valuable legislative experience and practice of other countries for reference and limiting the part of right of judicial office. Meanwhile, we should improve the protection of property right of criminal procedure by strengthening the justification of measures procedure of property involved in case.
