摘 要
本文根據我國《商標法》的規定，結合《反不正當競爭法》和《反壟斷法》的相關條款，針對馳名商標的法律認定進行了認真深入的研究和探討。從馳名商標認定的法律條件與法律標準分析入手，全面聽取了我國法律學者們對馳名商標認定的各種觀點和司法建議。比照世界公約組織制定的相關法律公約協定，總結了世界各國針對馳名商標法律認定的不同方法和不同手段，對照我國的法律法規和認定模式，進行了詳細的分析對比，講述了我國工商行政管理機關在馳名商標法律認定上的地位和作用，及其相關法律責任。同時認真分析了最高人民法院關于馳名商標司法認定的意見，并對其司法認定的觀點提出了不同看法，闡述了人民法院司法審判的制度原則，從理論上否定了人民法院針對馳名商標的認定權，以期對馳名商標法律認定的政出多門現象進行限制、對司法機關權利濫用可能產生的司法腐敗行為進行限制，確保商品市場公平競爭。并根據商標市場上出現的馳名商標管理混亂、馳名商標無原則認定、虛假馳名商標獨占市場的不正當競爭行為、知識產權使用不當的不規范現象、以及馳名商標被神化和異化的不正常現象，進行了深入細致的研究。依照法律法規，探討了《商標法》針對馳名商標認定的法律方法、《反不正當競爭法》針對馳名商標合理使用的方式、《反壟斷法》針對馳名商標認定進行規范的法律手段，結合《規定》、《要求》和《解釋》的規定要求，對我國馳名商標認定的法律標準和相關條件進行了全面認真的歸納總結，為加強商標管理，保護商標專用權、使用權，促使生產、經營者提高商品質量和服務質量，維護馳名商標信譽，以保障消費者和生產、經營者的利益，促進社會主義市場經濟的發展，從法律上奠定了馳名商標法律認定的理論基礎。文章最后通過法律比較、法律分析、法律研究的方式，歸納了我國馳名商標認定的法律上存在的漏洞、缺失和不規范的法條規定，同時針對《商標法》、《反不正當競爭法》、《反壟斷法》制度的規范與完善，發表了自己完整的觀點，進一步針對我國司法出臺的部分法規文件上的一些不適用、不合理的規定，闡述了筆者自己修正與完善的觀點，以期完善我國法律，促進社會和諧。

Abstract
Based on the stipulations of <The Law of Trade Marks> and considering relevant clauses of <the Law of Anti-illegal Competition> and <The Law of Anti-monopoly>, this article has made a prudent and deep study and research on the present status of the abuse of the famous trade marks in the Chinese trade marks market. Starting from the legal issues of the double-track recognition of famous trade marks, the author has comprehensively listened to the Chinese legal learners for their views and judicial opinions about the recognition on the right of famous trade marks. In comparison with relevant lawful treaty agreements established by the World Treaty Laws Organization, this article has summarized the legal means of various countries on restrictions of famous trade marks and international judicial methods and made detailed comparative analysis. This article has described the legal position of the state industry and commerce administration and its legal rights and responsibilities in terms of recognizing a famous trade mark and the rights restriction. Meanwhile, the article has prudently analyzed the opinions confirmed by the Supreme People’s Court about the legal recognition of the famous trade marks and raised different opinion about the point of views of the Supreme People’s Court. It has described judicial principles of the People’s Courts and theoretically denied the right of recognition of the People’s Courts so that the multiple routes of the Chinese legal system is suppressed and the abuse of the legal rights by judicial departments is restricted to maintain a fair commodity market competition. A deep study has also been made on the confusion of, the abuse of and the illegal competition about the trade mark rights, the irregular use of intellectual property right, the monopoly of famous trade marks and the abnormal situations of famous trade mark apotheosis and alienation. This article has, based on laws and rules, made research on restrictions of abuse of trade marks right as per <The Law of Trade Marks>, as per <The Law of Anti-illegal Competition> and as per The Law of Anti-monopoly>. An overwhelming summery has been made of the restriction means to restrict the abuse of famous trade marks right and a theoretical foundation has been laid to restrict famous trade marks right legally by means of strengthening trade mark administration, protection of trade mark right, guarantee of product and service quality by producers and operators, maintain of the trade mark reputation and protection of the interest of producers and operators in order to promote the development of the socialist market economy. In the end, the article has, by means of lawful comparison, lawful analysis and lawful study, summarized the shortcomings and irregularities of the Chinese laws and been of the author’s complete opinions in terms of specifications and perfectness of <The Law of Trade Marks>, <The Law of Anti-illegal Competitions> and <The Law of Anti-monopoly>. Furthermore, the author has also put forward his suggestions for correction and perfection of some regulatory documents in order to perfect the Chinese law and promote for a harmonious society.
